Beware advice that on the face of it looks cheap: it almost always turns out to be the most expensive

At KWW, we offer a bespoke service delivered by highly trained lawyers and solicitors. Our pricing reflects our professional skills and experience and the investments we are making as a firm in our administrative people and processes. You can always find someone to do something cheaper but please be careful to avoid taking unnecessary risks.

No two matters are the same so we would always recommend you contact us first to discuss your situation. We can then prepare a more accurate, personalised quotation for the work involved.

We have set out a guide to our pricing below to give you a general idea of what costs might be involved across the range of legal services we provide

Fixed price services

We know the issue of costs can be a sensitive one, which is why we have introduced a range of fixed-price services where clients know exactly what they will pay for a standard service, with the ability to top up where the service becomes less standard and more tailor-made.

Hourly rates

Typically, our non-fixed price charges are based on the time spent dealing with a matter. Time spent will include meetings with you and perhaps others, considering, preparing and working on papers, correspondence and making and receiving telephone calls. Purchase of Residential Property (Freehold and Leasehold)

The fee we give our client at the outset is the cost they need to pay. Our quote will include the details of the payments that will have to be made to other bodies on your behalf (disbursements), for example Stamp Duty, Land Registry fees and the various searches we will need to make against the property you propose to purchase.

We will supply you with a personalised estimate but as a guide the fees start from £995 + VAT. On top, we charge the following:

  • Drafting and submitting the Stamp Duty Land Tax return
    – £100 + VAT
  • Arranging the transfer of monies on completion
    – £35 + VAT
  • Electronic ID checks (per buyer) – £10 + VAT

 

Disbursements

  • Local Authority Search (varies) – circa £100 + VAT
  • Drainage & Water Search (freehold properties only – cost varies but Thames Water for example) – £59.47 + VAT
  • Ground Sure Home Buyers Report (environmental searches including flood data) – £59 + VAT
  • Chancel Indemnity Policy – £12.22
  • Index Map search – £4 + VAT
  • Bankruptcy search – £2 + VAT per buyer
  • Land Registry pre-completion search – £3 + VAT
  • HM Land Registry fee – based on property price but approx. £60 to £125.

 

Additional anticipated disbursement for leasehold properties

There are certain disbursements which will be set out in the individual lease relating to the property. The disbursements we anticipate will apply are set out below. The list is not exhaustive and other disbursements may apply depending on the terms of the lease. We will update you on specific fees upon receipt and review of the lease from the seller’s solicitors.

  • Notice of Transfer fee (if chargeable) is set out in the lease – approx. range £30 to £90
  • Notice of Charge fee (if property is to be mortgaged – approx. range £30 to £90
  • Deed of Covenant fee (provided by the management company for the property and often difficult to estimate – anywhere between £75 and £250
  • Certificate of Compliance fee (to be completed upon receipt of the lease) – approx. £75 to £150 

Fees vary from property to property and can sometimes be much more than the ranges set out above. We can give you an accurate figure once we have sight of your specific documents.

You should also be aware that ground rent and service charges are likely to apply throughout your ownership of the property. We will confirm the ground rent and the anticipated service charge when we receive this information.

Stamp Duty Land Tax

This will depend on the purchase price of your property. You can check the prevailing rates using the HMRC’s website.

We do not undertake tax advice.

Other cost factors

There may be factors which would typically increase the cost of the fees estimated above. Where there is likely to be any additional cost, we will inform you at the earliest opportunity and a clear estimate of those extra costs will be provided. Factors that may lead to an increase in cost include:

  • If a legal title is defective or part of the property is unregistered
  • If you discover building regulation or planning permission has not been obtained
  • If crucial documents we have previously requested from you have not been provided to us
  • If the property is a new-build
  • If the property is less than 10 years old
  • If you require to exchange or complete within six weeks of instructing us
  • If you require simultaneous exchange and completion.

 

Sale of Residential Property (Freehold and Leasehold)

Our fees cover all the work required to complete the sale of your current property. Each transaction is different and we will supply you with a personalised estimate. As a guide, our fees range from £950 + VAT.

In addition, we charge £35 + VAT for arranging the transfer of monies on completion through the banking system and £10 +VAT for each seller for electronic ID checks.

Disbursements

The cost for obtaining office copy entries from the Land Registry is £6 +VAT and a further £3 +VAT per document to obtain any other documents relating to the Title.

Exclusions

We do not undertake tax advice.

Wills can be straightforward and they can be complex. The simpler they are, the less you can expect to pay, although given the importance of this document, we would suggest the focus is on getting it to absolutely reflect your wishes.

Our price for a standard simple Will is £295, while a pair of standard ‘mirror’ Wills is £395. A Codicil to a Will is £150 and Codicil with mirror is £200. 

We do not charge for storing your Will. Prices exclude VAT.

There are two types of LPA – Property & Finance and Health & Welfare. Our charges start at £400 for an individual (single) LPA and £600 for any combination of two LPAs. For four LPAs, our charge is £1,000. All charges are subject to VAT.

The price excludes the court registration fee, which is currently £82 for each document.

Other costs, if appropriate, are:

Declaration of Trust from £395; Ordinary Power of Attorney £250; Registration or renewal of an existing Lasting Power or Enduring Power of Attorney £500; Court of Protection Deputy application as per statutory regulations £950;  Court of Protection application fee £365. There is no charge of Notice of Severance of Joint Tenancy (with Will instructions).

Our fees are based on the amount of work we do. You will be charged for each hour of work undertaken. Fees will depend upon individual circumstances.

One important factor that will affect fees is whether or not the estate is chargeable for Inheritance Tax and whether the more detailed IHT forms are needed. Other factors affecting the volume or work and therefore cost include:

  • Presence of a valid Will
  • Number of properties
  • Number of bank and/or building society accounts
  • Number of beneficiaries
  • Potential disputes between beneficiaries on the division of assets
  • Number of trusts in the Will
  • Missing beneficiaries
  • Any claims being made against the estate.


Grant of Probate/Letters of Administration only

Often the only difficult part in the administration of a straightforward estate is the preparation and submission of the Inheritance Tax (IHT) forms an the application for the grant.

If the executors/administrators obtain the necessary information, we can prepare and submit the forms on their behalf. The executors/administrators can then deal with the completion of the administration once we have obtained the grant.

Estates containing a property are often more complicated and therefore more costly. The executors/administrators may need additional advice regarding IHT or Capital Gains Tax. If this is the case, we reserve the right to charge for the extra advice.

Guideline pricing (note: VAT is not included on fixed price probate services)

  • Estate where no IHT is payable – from £1,500
  • Estate where IHT is payable – from £2,000


What we do

KWW will deal with the entire estate, including:

  • Obtaining date of death valuation of the assets and liabilities in the estate
  • Completing the IHT paperwork
  • Completing the probate application
  • Distributing the estate (to no more then six beneficiaries).

Anticipated Disbursements

  • Probate Court Fee – £155 (if using a solicitor – £215 otherwise)
  • Office copies for grant of probate – £1.50 + VAT per copy
  • Land Registry copy fee – £3 + VAT
  • Bankruptcy search fee – £2 + VAT per beneficiary
  • Confirmation of identity – £10 + VAT per person
  • Advert in London Gazette and local paper (estimated)
    – £150 + VAT.


Should further assets be discovered in the course of the administration, additional costs will arise. 

Exclusions

Additional services that will require the assistance of a third party at additional cost include accountancy services and tax advice and valuations for property, savings, investments or other assets. Where there is likely to be any additional or unusual costs, we will ensure you are informed at the earliest opportunity and a clear estimate of those extra costs will be provided.

The cost of selling or transferring a property is not included in our guideline pricing. If you require this service, we will be pleased to provide you with an estimate.

We offer a fixed fee initial consultation for £200 excluding VAT. This is a great opportunity for you to get the advice you will need to deal with a family or relationship matter or ancillary (financial) relief.  After the interview, you will receive a note confirming the advice, so you can refer back to it. We also offer a fixed fee of £1,450 inclusive of VAT and court charges for an uncontested divorce.

If you are bringing the divorce, it is open to you to obtain an Order for costs against your spouse, and further information can be given about this.
